Court remands 2 men in prison custody for alleged cattle rustling

A Minna Magistrates’ Court, has ordered the remand in prison custody of two men, Shehu Usman and Audu Likita for alleged cattle rustling and culpable homicide.

The defendants, whose house addresses were not given, are standing trial on charges of conspiracy, cattle rustling and culpable homicide.

The Police Prosecutor, Insp Ahmed Ali, told the court that one Umaru Yahaya of Hurenciki in Rafi Local Government Area of Niger, reported the matter on July 29.

Ali alleged  that the complainant and four of his colleagues, were grazing their cattle in the bush when unknown gunmen attacked them and made away with 200 of their cows and 100 sheep.

He told the court that the fleeing rustlers shot dead two of the complainant’s colleagues who had chased them.

The prosecutor alleged that police operatives arrested the defendants, who confessed to have committed the crime with three others, now at large.

He said the offences contravened Sections 3 (1) and 8(1) of the kidnapping and cattle rustling laws of Niger State and Section 221 of the penal code.

The judge, Christiana Barau, however, declined to take the defendants’ plea, saying her court lacked jurisdiction to entertain the matter.

Barau directed the police to forward the case file to the state Director of Public Prosecution for legal advice and ordered the remand of the defendants in prison custody until Sept. 26 when the case would be called for mention.
