A Wuse Zone VI Magistrates’ Court, Abuja on Thursday ordered that a businessman, Smart Okoye, who failed to meet his bail conditions to be remanded in Keffi Prison.
The police charged Okoye with allegedly stealing the ATM card of Mr Benjamin Dogbon’s ATM and making withdrawal of N685,340.
Okoye, who resides at No 5, Iyamoge Close, off Onitsha Crescent, Area 11,-Garki, Abuja is charged with theft.
Magistrate Linda Chimada, had admitted the defendant to bail in the sum of N400,000 with one reasonable surety in like sum.
Chimada also ordered that the surety must be a civil servant resident within the FCT, not below GL 08.
She adjourned the matter until Aug.15 for hearing.
The prosecutor further alleged that Dogbon had gone to a shop with the defendant a day before the incident to make some purchases with his ATM card and in the process, the defendant copied his pin code and thereafter stole the said card.
He said during police investigation, it was discovered from a CCTV footage that the defendant purchased some items which included an iphone X mobile phone valued at N350,000.
He said that the offence contravened the provisions of Section 287 of the penal code.
The defendant however, pleaded not guilty to the charge and his counsel Mr C. Ezeani made an oral application for his bail, citing sections 35 of the 1999 Constitution (as amended).
Ezeani also cited sections 158 and162 of the Administration of the Criminal Justice Act ( ACJA), 2015.
