Sales Rep convicted for criminally misappropriating N 793, 760

A Kubwa Grade I Area Court on Wednesday convicted a 36- year-old sales representative, Awoniyi Sunday, for criminally misappropriating N793, 760.

The judge, Ibrahim Balarabe, convicted Sunday, who was charged with criminal breach of trust, misappropriation and cheating after he had pleaded guilty.

Balarabe however ordered that the convict be remanded in prison custody and deferred his sentencing until May 13.

The convict had earlier pleaded not guilty in November 2018, but changed his mind, saying he wanted to leave the prison where he had been remanded to be able to pay back the complainant.

Earlier, the Prosecutor, John Okpa, told the court that one Vajime Terungwa, Manager of J.O. Adebiyi and Sons Nigeria Limited, Kubwa Expressway, reported the matter at the Kubwa Police Station on Nov.21, 2018.

Okpa said Sunday was saddled with the duty of taking goods from the warehouse of Suntory Foods and Beverages to supply customers and remit the proceeds into the company’s bank account.

He said that the convict sold N793, 760 worth of goods and fraudulently converted and misappropriated it to his use.

The prosecutor said that the offence contravened Sections 311, 309 and 322 of the Penal Code.

The defence counsel, Olabisi Palmer, urged the court to temper justice with mercy, considering that Sunday changed his plea and admitted the charges without wasting the time of the court.
